The man who attacked a 13-year-old boy with a hammer, in Windsor, is most likely going to be deported.
Defence Lawyer Frank Retar says Rafid Jihad came to Canada as a refugee from Iraq in 2002, and is now a permanent resident, but that will be changing. "The Act says that if you're convicted of an offense with a minimum of six-months of jail, and no less than a 10-year potential jail sentence -- which this (attempted murder) is an offense with a maximum sentence of life in prison -- he will lose his status," explains Retar.
He says the immigration panel will make an order of deportation once Jihad's done serving whatever time he's sentenced to. His client can then appeal that order, but Retar doesn't think that Jihad will appeal.
The defence is asking for a jail term of two years, given that Jihad's already served more than a year in prison for attempted murder.
Sentencing is set for September 25 at the Ontario Superior Court of Justice in Windsor.
