Turbine Appeal To Be Heard In Court Today

Divisional court in London will hear an appeal at 10am Tuesday on Suncor and Nextera's Cedar Point Wind Power Project.

Local Industrial wind turbine opponents are appealing a ruling by the Ontario Superior Court of Justice to allow for the construction of 46 turbines in Plympton-Wyoming.

That ruling was upheld by the Environmental Review Tribunal in March.

WAIT-PW spokesman Santo Giorno says the review tribunal failed to explain how they arrived at the decision that the project won't cause serious harm.

He says residents have a number of issues with the turbines.

"One lady said she can't sleep upstairs because the roof vibrates so they're concerned about that and they're also concerned about the resale value," says Giorno.

"We've talked to real estate agents who said when they bring clients out to look at a house and they see a turbine in the field behind them a lot of them say lets go look at the next one, so they're concerned about the financial hit that they're going to take."

Giorno says if divisional court agrees with their argument, the project can't be considered "confirmed", even though it's already up and running.

That could lead to the possibility of further review or mitigation.
