Shawn Drennan says the Divisional Court will decide how much they have to pay three wind energy companies for legal costs in their court battle to have the wind energy projects halted.
The Drennans' are one of four families who have been jointly billed 340-thousand dollars by K2 Wind Energy, Armow and St. Columban for their legal costs in defending their projects in Ashfield-Colborne-Wawanosh, Kincardine and Huron East.
Drennan explains they've filed papers with the Divisional Court claiming they are a Public Interest or First Instance Test Case and they will not gain any more than anyone else in Ontario from a ruling that sets out the constitutionality of the Green Energy Act and the Environmental Protection act.
Drennan adds it will be up to the Divisional Court to determine fair and reasonable legal fees. Separate from the Divisional Court ruling on legal fees, Drennan says they are also asking the Ontario Court of Appeals to hear their original case.
