First court date related to Dresden landfill pushed back two weeks

The Municipality of Chatham-Kent will meet York1 in court on March 17.

The original hearing was set for the morning of March 3, and as of the evening of March 2 no reason has been given for the postponement.

In November, the municipality was served a court challenge by York1 Environmental Waste Solutions Inc. arguing that the company doesn't need any land use planning approvals from the council to proceed with it's proposed landfill expansion.

According to the municipality, the argument is based on the legal concept of legal non-conforming use.

Chatham-Kent believes that approvals are required, including zoning and official plan changes.

The court date, at the Chatham Superior Court, is procedural in nature and won't involve a hearing at this time. At this time, the two parties will set deadlines for the exchange of materials and identify timelines for any cross-examinations that may be required.

The municipality will provide further updates as additional information becomes available.
