A Ridgetown hit and run case is at risk of being tossed out of court because of a lengthy delay.
The Chatham court was told on Monday that the John Wilson case will have eight days of pretrial motions beginning November 10, 2025 and a 10 day trial will begin with jury selection on March 2, 2026. The trial date will be confirmed on June 30, 2025.
However, the defence anticipates applying for a delay motion to be considered under the Charter of Rights, meaning the case could be dismissed after two years in court.
Wilson, 39, of Ridgetown, is accused of killing Wendy Clark, 66, of Howard Township.
Clark was struck by a vehicle in broad daylight in Ridgetown on October 19, 2022.
She was getting out of her own vehicle on Main Street when she was hit. The suspect vehicle did not stay at the scene.
Clark was airlifted to a Windsor hospital with life-threatening injuries and died two days later.
Wilson is facing charges of dangerous driving causing death and failing to remain at the scene of a collision resulting in bodily harm. An impaired driving charge was dropped in Chatham court in August 2024 because of conflicting evidence.
The objective of a Charter application for delay is to provide for a fair, timely and efficient trial within a reasonable time.
The case is under a publication ban that prevents more information and evidence from being made public.
